1. Introduction
MaxBrain AG has drafted this Privacy Policy in anticipation of the upcoming revision of the Swiss Data Protection Act (DSG) and the entry into force of the General Data Protection Regulation in the EU (EU GDPR). MaxBrain AG hereby provides detailed information about how it handles your data.
MaxBrain AG reserves the right to modify the content of this Privacy Policy if new or modified services are made available, or if changes in the law make such an adjustment necessary or advisable. This applies provided that the changes are reasonable for the user, taking into account the interests of MaxBrain AG.
2. Scope
MaxBrain AG processes personal data that the company receives from its own customers in the course of its business relationships. In addition, to the extent necessary for the provision of its own services, MaxBrain AG processes personal data that is lawfully collected from publicly available sources (e.g., commercial registers or websites).
MaxBrain AG uses personal data without further consent solely to enable the use of the services offered, as well as to fulfill and process inquiries and registrations. Additional personal data is collected, processed, and used only with consent if such information is provided voluntarily—for example, in connection with an inquiry, search request, or for the purpose of substantiating, defining the content of, or processing an inquiry, as well as for billing purposes—and if it is necessary for responding to or processing the inquiry.
3. Data Sharing
MaxBrain AG does not, as a general rule, disclose personal data to third parties unless consent to such disclosure has been expressly given for the specified purposes, or unless the disclosure is expressly permitted or required by law.
However, the prohibition on data disclosure does not apply to the extent that MaxBrain AG is required, upon order of the competent authorities, to provide third parties—in particular government agencies—with information regarding customer data on a case-by-case basis, to the extent that this is necessary for the purposes of criminal prosecution or to enforce MaxBrain AG’s intellectual property rights, as well as pursuant to other applicable legal provisions in this regard. No further consent is required for this purpose.
4. Purpose of the Processing of Personal Data
MaxBrain AG is permitted to collect, process, and use the data collected in connection with the use of the services provided for the purposes of its own consulting and advertising, but above all to improve the products and services we offer. In addition, we may transfer the collected data, to the extent necessary, to service partners involved in the provision of services, provided that the intended purpose of the data is maintained.
However, such disclosure is limited to the extent required by law and strictly necessary.
5. Data Security
Personal data is transmitted over the Internet in encrypted form both on the website and through the services offered. MaxBrain AG protects all services it offers against loss, unauthorized access, destruction, manipulation, disclosure, and dissemination of your data by unauthorized persons through technical and organizational measures in accordance with recognized industry standards.
The MaxBrain servers are located in multi-certified and secure data centers in Germany.
MaxBrain operates an ISMS (Information Security Management System), which is regularly updated and certified in accordance with ISO 21007.
6. Web Analytics
The company’s website, MaxBrain.com (but not any related services), uses the web analytics service Google Analytics (Google Ltd., Ireland, Dublin). This tool can collect both anonymous and personally identifiable data. In general, it is possible that the collected data may be transmitted to a Google server in the United States. MaxBrain AG has no detailed knowledge of what data is transmitted to third-party providers, where it is transmitted, or whether it is anonymized. MaxBrain AG cannot associate this data with specific individuals.
Furthermore, this data is not combined with any other data sources. The storage and statistical analysis of this non-identifiable data serve solely to ensure system security and the security of user data (e.g., detecting program errors or attacks on the system).

7. Cookies
MaxBrain.com and other integrated systems use what are known as cookies. These are small text files that are stored on your device via your browser. They do no harm. MaxBrain AG may use cookies to make its website more user-friendly. Some cookies remain stored on your device until you delete them. This allows MaxBrain AG to recognize your browser the next time you visit.
If you do not wish this to happen, you can configure your browser to notify you when cookies are set and allow the maxbrain.com website to set cookies only on a case-by-case basis. Disabling cookies may limit the functionality of the website.
8. Newsletter
You have the option to subscribe to a newsletter through MaxBrain.com. To do so, we need your email address and your consent to receive the newsletter.

9. Your Rights
Under applicable data protection laws, you have the right at any time to request information about the personal data stored about you, its source and recipients, and the purpose of its storage, as well as the right to have your stored data corrected, blocked, or deleted.
If the deletion is precluded by statutory, contractual, commercial, or tax-related retention periods or other grounds, your data will be blocked instead of deleted.
